US Marshall Receives 6 1/2 Years For Wife's Murder

Tags:
@ 06:10 AM (23 months, 15 days ago)
Karen’s mother, Sandy Etter, provided a prepared statement when asked to comment about the verdict. She believes Ludwig was found guilty of a lesser charge because of special treatment for his 30-year tenure in law enforcement, 17 of those with the U.S. Marshals Service. "All of the family and my friends and co-workers are just sick,” she stated. “It is unfair and we feel that he is getting away with murder because of who he is. I am very disappointed, I just can't even put it into words"...

Family memebers of the woman shot and killed by her U.S. deputy marshal husband last year said the sentence of 6.5 years in prison recommended by a jury last week does not fit the crime.

Members of Karen Ludwig’s family said this week they were shocked with the jury’s July 20 decision and believe the defense led the jury to believe that she was evil and mean-spirited. It's always the victim who is portrayed this way, especially a wife of someone on Law Enforment.

John Ludwig, 52, was originally charged with murder and using a firearm in the commission of murder. After five hours of deliberation, the jury found the former marshal guilty of voluntary manslaughter and using a firearm in the commission of a felony on July 18. The jury then took more than a day to return a sentence recommendation of 3.5 years out of a maximum 10 years for the manslaughter charge; the charge of using a firearm in the commission of a felony carries a mandatory three-year prison term. Ludwig will be sentenced formally on Nov. 2 and Circuit Court Judge James H. Chamblin can only reduce the sentence as recommended by the jury, not increase it. The jury also recommended Ludwig perform an undetermined amount of community service following his release from prison.

Ludwig never contested that he shot his wife five times on July 4, 2005, but during his five-day trial he testified that the shooting was in self-defense after his wife pointed a gun at him during a heated argument in their bedroom.  Hard to believe a highly trained officer had to defend himself and shot his wife, 5 times, please spare me. He employed 30 years of law enforcement training in using deadly force to protect himself from what he said was a lethal threat from his wife.

His attorney, Alex Levay, called two expert witnesses who said Ludwig might have suffered amnesia, attributed to the large amounts of alcohol and painkillers he ingested after the shooting in a suicide attempt. Ludwig told the jury he did not contact the sheriff’s office about the shooting until two days later because he was in a daze from the drugs and alcohol.

His lawyer called more than 10 character witnesses to the stand who said Ludwig was a peaceful man who could be trusted. That's how they are, when are people going to wake up!  Brandy Snider, 19, said her mother never abused her and that the defense mischaracterized her mother during the trial.

Snider said she believes Ludwig murdered her mother and she was angry when he testified he shot her in self-defense, considering that it took him more than a month to remember the most important part of his defense. She said his testimony was unbelievable.

Plowman said he doesn’t agree with the jury’s verdict but that he “respects the fact they made a decision and I accept it.”

“If the community is OK with it, then I am OK with it,” Plowman said.

Karen’s only sibling, Kathy Farrow, said the jury’s verdict was a huge disappointment and that the punishment does not fit the crime. She made a reference to the Ten Commandments: “Thou Shall Not Kill.”

“I thought it was an injustice toward Karen,” she said about the jury’s verdict. “Once again, she is a victim in all of this.”
Farrow said Ludwig gloated about his marshal service and that his testimony was rehearsed. Although there was a period in their adult life where the two sisters weren’t speaking, Farrow said her sister didn’t deserve to be killed just because she may have verbally attacked Ludwig.

He’s now a murderer. That’s who he is now. The last thing he did was he murdered someone. He murdered my sister.”

Stem Cell Bill May Be Dead- But Research Will Continue

American's seem to be jumping up and down in protest over President Bush's veto of the embryonic stem cell research federal funding bill.  These days anything the President seems to do is like a sour grape with many people.  But, consider for a moment what the President actually did in vetoing the bill. The issue is whether or not federal funding should be provided. And nothing more.

Convicted Serial Killer Denied Freedom, But Has Hope

On 5/26/06 I wrote about convicted serial killer Patricia Palumbo Reforming A Murderer Is Not Possible .  This past week she was in front of the Illnois Prisioner Review Board, for the 14th time in an attempt to be released from prision.  She was only 17 years old when she slaughtered her entire family.  She has been in prison for 30 years.  And you guessed it "she has changed her life."  She's not the same person and she's hopeful she'll be released when she appears again in front of the Board.  This hearing was different she won the support of 2 prison review board members. By a slim vote, the board agreed to set Columbo's next parole hearing for next summer. She has been behind bars for 30 years after being convicted of the 1976 deaths of her parents and her 13-year-old brother in Elk Grove Village. Columbo was sentenced along with boyfriend/co-defendant 37-year-old Frank DeLuca to 200 to 300 years. DeLuca is serving time in Centraila.  In my opinion, she should not be released.  What would she do to become a productive member of society?  Go around the lecture circuit, ger paid to speak and say she's sorry? This is not something that should even be entertained by the review board.

Diabetic Study Hopeful in Lowering Insulin Levels

@ 03:43 AM (23 months, 18 days ago)
I have been a diabetic for many years and although my doctors have tried over the years to get me to take insulin I have found other alternatives to lowering my blood sugar.  In my opinion, like our fingerprints everyone's system is different.  I was very happy to see this new study about lowering insulin levels. I have been following this type of program for about six years and although it has been sucessful for me, you still need to consult a doctor before altering your food intake and medication.  Hopefully, the AMA can recognize other treatment options that would be useful to people who are insulin dependent. The study says people who ate a low-fat vegan diet, cutting out all meat and dairy, lowered their blood sugar more and lost more weight than people on a standard American Diabetes Association diet, researchers said on Thursday.

They lowered their cholesterol more and ended up with better kidney function, according to the report published in Diabetes Care, a journal published by the American Diabetes Association.

Yates Jury-Blind, Deaf & Dumb

Most of us by now we have learned of the verdict of Andrea Yates.  Even Drunken Wisdom's blog here are bloghi has voiced his opinion, rather well, on the tragedy on today's jury verdict. A mother and five helpless angels, killed one by one, in cold blood.  Wouldn't it have been just as easy for Yates to  relinquish  her rights as a parent or perhaps just leave the home, walk out of their lives? What about the husband?  How could he have just left the children at home knowing something was wrong. And then Yates himself, today, commenting ever so calmly as he has since day one,  after the verdict saying he hopes she now receives the proper medical care that she would not receive in a prision.  What was the jury's decision based upon? What was the jury blind, deaf and dumb? Is that who was selected to reach a verdict?  A legal anyalyst with Fox news Susan Schecter was on a program with Ann Coulter discussing a different topic when it was her turn to speak she said "I'm sorry, Excuse me, but isn't anyone else outrage over the Yates verdict? The States of Texas had it's chance to fix the system after Hinkley it did not and that's why your seeing this verdict today"  This is a dangerous verdict for future cases in Texas and across the country. Police Use The Internet To Conduct Auctions

Tags:
@ 05:42 AM (23 months, 20 days ago)

Move over eBay, there's a new Web site in town. With its stolen and unclaimed goods, http://www.PropertyRoom.com is literally the "hottest" online auction around.

The Web site works with law-enforcement agencies across the country, including the St. Louis Police Department, which joined in April. It's taken the place of the department's annual auction, which has reduced some of the hassle that went with it.

"An unlimited number of people can see the auction through the Web, compared to maybe 100 to 150 people who'd go to an auction," Lt. Bob Dunigan said. "I estimate we're saving $2,000 plus by not having the auction."

But the department isn't the only beneficiary; the online setup is better for buyers as well. Dunigan said that in past auctions, a box of car radios would be sold, regardless of their condition. But PropertyRoom.com will clean, test, describe and photograph all of them, then individually sell only the working items.

The Web site's founder, Tom Lane, confirms that.

"If we say it's a real Rolex, it's a real Rolex," said Lane, who's based in Mission Viejo, Calif., and started the site in 1999. "If they're phony Rolexes, we destroy them."

Lane served as a police officer and detective in Long Beach, N.Y., from 1971 to 1978 and often cleaned out the department's property room.

"I thought if we could get all the property from police departments to one site, we could show it to more people," he said.

The Web site offers an additional service, however, with its sister site, StealItBack.com. People can register serial numbers or other pertinent information about stolen property at this Web site, Lane explained. Before posting an item on the online auction, PropertyRoom.com employees check it against the Steal It Back database. If the item matches an entry, it's returned to the owner rather than auctioned.

The proceeds from auctioned items go to the police departments from which they originated. In St. Louis, the proceeds are used as they always have been: to fund the Police Relief Association, an organization that provides financial aid to sick or injured officers.

National Registry Identifies Bad Cops

Tags:
@ 05:38 AM (23 months, 20 days ago)

WASHINGTON —Finally a National Registry for Police Officers gone sour.  A registry of more than 7,000 police officers who have been stripped of their law enforcement licenses is being readied for use by police agencies throughout the USA to identify officers with troubled histories. This includes spousal abuse, officers who resign or take early retirement.  Departments across the will be also be able to access an officers allegations of misconduct.  Instead of the officer making up excuses as they have been known to do many times in the past.

The registry, which for the first time would give police agencies direct access to a list of decertified officers, is designed to help avoid hiring officers ousted from jobs elsewhere.

So far, 20 states are contributing to a computer database being assembled by the International Association of Directors of Law Enforcement Standards and Training (IADLEST). The database could be ready this fall.

According to USA Today, there have been no national studies on how often disciplined or decertified officers have found work at other departments, the database reflects rising concerns about the quality of police recruits.

In Florida, the Broward County Sheriff's Department faces questions about its hiring practices in a lawsuit involving Sheriff's Deputy Lewis Perry. Perry had left two police jobs in Connecticut after conduct complaints were filed against him, court documents show.

He was fired from a third Connecticut agency while under investigation for allegedly stalking a girlfriend, court papers say. In Broward, Perry has been suspended without pay because he faces allegations of misconduct and perjury. A grand jury also is reviewing his conduct in a 2004 shooting. Perry's attorney, Eric Schwartzreich, says he has not reviewed the Connecticut evidence, but he notes that Perry's certification hasn't been revoked.

The new database will flag only officers who have been decertified by state accreditation agencies. While more states may sign on, records for thousands more ousted officers are under the control of state accreditation agencies that have chosen not to share the information or are prohibited by law from sharing it. Police agencies in all states would be permitted to use the database.

Project director Ray Franklin says incidents of misconduct that don't result in decertification could be added as the database expands.

Police officers typically are licensed by state agencies when the officers graduate from law enforcement academies. Officers remain accredited as long as they meet job standards. When they violate such standards, the loss of their law enforcement accreditation is supposed to prevent them from working as officers elsewhere. However, police departments — particularly those in different states — historically have not shared such information.

In the past three decades, more than 19,000 officers have been stripped of licenses for misconduct, according to a 2005 IADLEST survey.

"Some people view this as kind of like a blacklist," Franklin says. "It's really not. It's more like a pointer system, a reference for public safety agencies."

Drunk Drivers Who Kill Receive Lenient Sentences

Tags:
@ 04:10 AM (23 months, 21 days ago)

You would think that with all the laws regarding drunk driving and convictions, judge's would use the state sentencing guidelines when it comes to prison time for all offenders.  That's not happening in many places across the country.  In Minneapolis, for example, a news paper investigation revealed that drunk drivers received less jail time than what the law dictates. This also incuded drunk drivers who fled the scene of a fatal accident or had a history of repeated drunk driving arrests.

According to the Pioneer Press:  "If you're on the roadway, and you're drunk, and you kill someone, your chances of going to prison for any length of time are pretty remote," said Chief Deputy David Bellows of the Dakota County sheriff's office, who lost his mother to a drunken driver in 1981. "To me, it's incredible how society de-emphasizes death on the roadway."

..."This situation has become so unbearable and out of control that I do not know what to do," Otilia Burton wrote in court records filed as part of divorce proceedings, which she began in September... Burton returned to the couple's Cartilla Court home in February, despite his wife's objections. Her lawyer, said they went to court to try to kick him out, but the motion was denied by a judge... Otilia Burton once came in with a black eye, and Burton told one of Hartog's assistants that if the divorce proceedings were completed, he would kill Otilia, the lawyer said...
RANCHO CUCAMONGA - Colleagues of Michael Burton say the Pasadena firefighter was an outstanding individual, both personally and professionally. (they always say that after the fact)

Neighbors recall a family man who loved his children and would shuttle them to and from school.

But a more frightening picture is emerging after police stormed his home Sunday and found his wife, Otilia, dead with stab wounds and arrested Michael Burton, 45, on suspicion of murder.

"This situation has become so unbearable and out of control that I do not know what to do," Otilia Burton wrote in court records filed as part of divorce proceedings, which she began in September. The couple separated two months earlier and he moved out when she filed for divorce. The 35-year-old woman's full name was Jesus Otilia Burton, but neighbors say everyone called her by her middle name.

The San Bernardino County Coroner's Office is set to conduct an autopsy on her body. Burton was still in a hospital Monday night with self-inflicted stab wounds.

Otilia Burton had said her husband was controlling, manipulative and emotionally and verbally abusive to her and their children, records state.

But Burton denied the accusations and he and his sister, Pamela, portrayed a different woman in court documents.

They said that Otilia Burton was neglecting her three children - a daughter, 18, and two sons, one 12 and the other 9 - and left them alone frequently.

The two also accused Otilia Burton of allowing the children to find out about a relationship she was having with another man.

Otilia Burton admitted to the relationship but denied leaving her children alone, saying she had to work part time at Coco's Restaurant in Rancho Cucamonga while she completed nursing training. It was a career opportunity she said her husband at first encouraged, records state. She added that he was the one who told the children about the relationship.

Burton returned to the couple's Cartilla Court home in February, despite his wife's objections. Her lawyer, Diane Hartog, said they went to court to try to kick him out, but the motion was denied by a judge.

Otilia Burton once came in with a black eye, and Burton told one of Hartog's assistants that if the divorce proceedings were completed, he would kill Otilia, the lawyer said.

"We were all really worried about her," Hartog said. "I was afraid she was going to become a statistic."

While court records state that a sword and gun were taken from Burton in previous visits by police, Otilia Burton noted one chilling threat.

"He has threatened me and told me he has a samurai sword and that he was going to use the sword to chop up my boyfriend," she declared in the court records.

Neighbors knew about the couple's pending divorce, but no one knew how troubled the relationship was.

Carlos Llanos, who lives two houses away, said his son was good friends with the Burton's 9-year-old boy.

"I was pretty devastated about what was going on in his marriage," Llanos said. "He lost a lot of weight and was depressed" when divorce proceedings began.

"Cowardly Lion Liar Syndrome" Within Law Enforcement

Tags:
@ 04:12 AM (23 months, 26 days ago)

Let's see.  A trained US Marshall murders his wife and is found guilty of manslaughter, the most the bozo can serve is 13 years.  I realize know one knows what takes place behind closed doors.  But, when any law enforcement officer has murdered another person, child, wife. girlfriend and then declares "she came after me" or I was protecting myself" it's nothing more than smoke and mirrors.  I call it the "cowardly liar lion" syndrome.  The events in these cases are suspect.  And yet, tragedy, after tradegy, a cop, if he doesn't take his own life cook's up one hell of a story.  This is one of those situations. Today, a jury today found a U.S. deputy marshal guilty of voluntary manslaughter for fatally shooting his wife July 4, 2005, and it will return to court tomorrow to recommend a sentence.

http://www.blogstream.com/gallery.mod?G=strangephraseindeed&RT=strangephraseindeed&PRID=18462&IID=24079&IMG=24079_18462.gif

John Ludwig, 52, of Ashburn, was charged with first-degree murder and using a firearm in the commission of a felony for fatally shooting his wife Karen Ludwig, 38, in the couple’s bedroom. The jury also found Ludwig guilty of using a firearm in the commission of a felony, which carried a mandatory three-year prison term. The voluntary manslaughter charge carries a maximum of 10 years in prison, so the maximum sentence Ludwig can get is 13 years in prison.

Prosecutor Robert Vernail told jurors Ludwig was a cold-blooded killer who premeditated the murder with malicious intent.

Ludwig’s attorney, Alex Levay, said his client was acting in self-defense after Karen pointed a gun at her husband during a heated argument. There is no proof, but because the man's attorney planted a reasonable doubt in the bozo's defense his finding by the jury was not premeditated murder.

By finding Ludwig guilty of voluntary manslaughter, the jury had to believe that Ludwig killed his wife intentionally, but in the heat of passion.

Levay and Vernail would not comment until after the jury recommended its sentence, which is expected to conclude tomorrow.

Mickey Spillane creater of the sex, murder and drama series dies

One of the first books in a series I read as a teenager was Mike Hammer.  I'd hide it under my bed every night after reading a chapter or two. The books were a quick read and at times a pager turner.  Spillane gave definition to crime, sex and drama, although he wasn't fully appreciated for his talents at times, he had a huge audience.  He will be missed.

Mickey Spillane, created  Mike Hammer, the heroic but frequently sadistic private detective who blasted his way through some of the most violent novels of the 1940’s and 50’s, died yesterday at his home in Murrells Inlet, S.C. He was 88 and had homes in South Carolina and New York City.

THIS ARTICLE DOESN'T MENTION THE MOTHER LEFT TO LIVE WITH THIS OR THE SON WHO LOST HIS LIFE.  Another one sided news story?  Or a society numb to violence in the home.

...Lash's résumé was long and quintessential of the Washington elite -- an Ivy League pedigree, high-powered law firms, a presidential appointment, think tanks, boards of directors, guest spots on television news programs, and prestigious university positions. He had an undergraduate degree from Yale University, a law degree from Harvard University. He clerked for a New Jersey Supreme Court justice. He served as counsel to the chairman of the U.S. International Trade Commission during the Reagan years, worked for the law firm of Fried, Frank, Harris, Shriver & Jacobson and served on the boards of directors of private and publicly traded corporations. In 1994, he found a place in academia on the GMU law faculty...

According to Saturday's Washinton Post, A former Bush administration official, after arguing violently with his wife Thursday night, shot and killed his 12-year-old son inside their McLean home, then turned a shotgun on himself and committed suicide.

William H. Lash III, 45, was an assistant secretary of commerce from 2001 until last year, then returned to teach at George Mason University Law School in Arlington, where he had begun as a professor in 1994. His wife, Sharon K. Zackula, fled the house before the shootings, and police said yesterday they were not sure what ignited the murder-suicide in a first-floor bedroom.

Friends and neighbors described Lash as devoted to his only child, William H. Lash IV, who was autistic. Will Lash had just completed sixth grade at Haycock Elementary School in the Falls Church area, Fairfax school officials said. The father and son could often be seen side by side on the swing set in their back yard, one neighbor said, and the pair often attended Washington Nationals baseball games.

Police said they had not been summoned this year to the blue expanded Cape Cod-style home on Pathfinder Lane in the West McLean neighborhood. There was no record of any domestic complaints. Neighbors said the family kept a low profile.

But shortly before 10 p.m. Thursday, police said, Lash and Zackula had a dispute and Zackula ran from the house and called police. Zackula was not hurt, but the dispute was physical enough that police later obtained a warrant charging Lash with domestic assault, Officer Richard Henry said.

Lash never knew about the warrant. When three or four officers arrived at 9:55 p.m., Henry said, they knocked on several doors but got no answer. Within 10 minutes, while trying to decide their next move, the officers heard two gunshots from inside the house, Henry said.

Not knowing who was shooting -- and who was being shot at -- the officers called for help. Teams of tactical officers and hostage negotiators were summoned, Henry said. Black-clad officers with rifles darted across front lawns, a command post bus was brought in, and police dispatchers phoned neighbors with urgent instructions: Turn off all lights and get in the basement, neighbors said.

After phone calls failed, a police negotiator began circling the house with a bullhorn, two neighbors said. The negotiator gently pleaded with Lash, "Bill, we need to know you're okay," the neighbors said. "Please give us a sign. Answer the phone. Turn on a light."

The negotiator tried to reach Lash for more than two hours. "He was incredibly compassionate," said one neighbor, who spoke on condition of anonymity.

After 1 a.m., police released a remote-controlled robot, equipped with a video camera, so police could gauge what was happening inside. The neighbor said the robot rolled slowly down Pathfinder Lane, up the Lash driveway and into the house.

Finally, at 3:50 a.m., officers went inside and found Lash and his son, both dead from gunshots to the upper body.

Daniel D. Polsby, dean of GMU's law school, said, "This thing just doesn't belong to the normal range of human experience, and we're all just heartbroken for his family, his community and for ourselves."

Lash was born and raised in New Jersey, where his parents still live.

Zackula, a lawyer with the National Association of Securities Dealers, could not be located yesterday.

An Arizona man has been charged with beating a 3-year-old girl recorded some of the incidents on video, according to police reports. But why has the mother come forward now?  She must have suspected something or the child told her and maybe she dismissed the childs accusations.  I find this case questionable.  I think the mother should also bee investigated in this case.  Why was the child even left alone with this man?  And where was the mother when all this was happening?

Is it fair to allow someone like Cynthia McKinney back into Congress for a second term?  It's not up to us by the voters in her district.  While the rest of the world viewed McKinney's outrageous behavior, the voters view her as someone who stands up for herself and isn't afraid to speak her mind.  That outburst would have hurt many a politician, but it will play well for her come November.

Is Castration Effective Enough To Cure An Offender?

Tags:

The State of Virgina is currently debating castration as treatment for convicted sex offenders. State Senenator Emmett Hanger Jr., R-Augusta, proposed a bill that would give offenders the option to  be surgically castrated at the end of their prison sentence, prior to being released back into society. The Senator had second thoughts about the bill so he withdrew it pending more information because the courts might see castration cruel-and-unusual punishment. Not much resaerch is available on the subject  I don't think a person can ever be cured of this kind of behavior.  At least I've not heard of the any concrete documentation. The Senator claims that sex offenders would volunteer for the procedure should allay such concerns. He hopes to introduce a revised version in the next session.

The Infatuation With Tattoos

Tags:

The popularity of body art ebbs and flows like ocean waves. Its ancient heritage is surrounded by physical pain, the mental shock of being marked for life and personal rebellion which brought it into the mainstream in the 1920s. In 2006, many teens do whatever they can to get one.

In states such as Massachusetts and Oklahoma, tattooing is illegal. The reason: AIDS is still an incurable disease that can be passed through dirty needles. In order to operate legally, all tattoo shops must use sterile equipment.

Tattoos have become a fashion statement judging by their growing popularity among teens and adults alike.

Some reasons for the spontaneous outbreak of tattoos among teens comes from its reputation among famous people. Music and Sports celebrities have tattoos and teens who idolize them want to get one too.

The history of tatoos dates back to a 5,300-year-old frozen man found near Innsbruck, Austria with a cross behind his knee and lines on his back. In the 1880s, it became commonly known when upper class Americans would travel as far as Japan to decorate their bodies. The actual word "tattoo" comes from the Tahitian word "tatua," which means to mark the skin.

The working class adopted the art when tools became available. That sparked the big fetish for tattoos in the 1950's. Tattoo shops popped up like jack-in-the-boxes all over Coney Island. A picture of a well-endowed woman, a skull with cross bones and a little heart that read "Mom" could all be purchased for about $15. Now tattoos range from $50 and up depending on and where you go.
